The young woman arrived outside 26 Federal Plaza around 5 a.m. for her immigration court hearing. For several hours she stood in line for her scheduled court appointment, not knowing she was waiting in the U.S. Immigration and Customs Enforcement (ICE) check-in line and not the line for court.<\/p>\n

By the time the woman entered the building later in the day, she had completely missed her hearing. The judge issued her a deportation order.<\/p>\n

\u201cIt was too late,\u201d said Michelle Martinez, a supervising staff attorney at the Central American Legal Assistance (CALA) group, who assisted the woman, an asylum-seeker from South America, earlier this year.<\/p>\n

In recent months, more than 26,000 migrants have arrived in New York City, overwhelming the New York ICE office. However, advocates and attorneys say the ICE check-in situation outside 26 Federal Plaza, which houses the City\u2019s ICE Office for check-ins, the City\u2019s busiest immigration court, and the U.S. Citizenship and Immigration Services office, has caused additional confusion for immigrants facing court hearings.<\/p>\n

If a person misses their immigration court date \u2014 as was the case with the young woman helped by CALA \u2014 a judge often automatically issues an \u201cin-absentia\u201d deportation order. If the order is not resolved, which is most easily done with the help of a lawyer, individuals could be deported to their home country.<\/p>\n

For the judge to rescind a removal order, individuals must file a motion to reopen their case. In cases where someone was at the courthouse, this process can include submitting evidence, like photos, to prove they were there.<\/p>\n

\u201cIt makes all the difference to have an attorney and to know who to reach out to, and try to diligently get this solved,\u201d Martinez said. \u201cOtherwise, you have an order of removal against you, and with the more time that goes by, the harder it could be to reopen it.\u201d<\/p>\n

To fight the deportation order, the woman searched for legal help from CALA. Martinez said a judge eventually granted the motion to reopen the woman\u2019s case, and she will have another chance to appear in court. But the challenges she faced were unnecessary, Martinez said.<\/p>\n

\u201cIt could have been so easily avoided,\u201d she said. \u201cPeople are simply trying to comply with their appointments and their obligations, and instead are met with this disorganized chaos when they get there.\u201d<\/p>\n

For many who come to 26 Federal Plaza, the difference between the ICE check-in line and the line for immigration court dates may not be clear. The line for ICE check-ins sometimes begins the night before, as hundreds of people gather on one side of the building. Around the corner is the line for immigration court with crucial differences \u2014 it\u2019s shorter, begins later, and moves more quickly as people are let in for their appointment times.<\/p>\n

An absence of signage for the separate lines, a dearth of attorneys to guide individuals through the processes, and a lack of adequate instructions in native languages have left many susceptible to missteps with potentially drastic consequences.<\/p>\n

Evangeline Chan, the director of the Immigration Law Project at Safe Horizon, has been practicing immigration law for more than a decade in New York. But the extraordinarily long lines were something new to her. \u201cThose kinds of lines, I don\u2019t remember ever seeing,\u201d Chan said.<\/p>\n

Now, non-detained people can have their day in immigration court at Broadway, Varick or Federal Plaza.\r\n\r\n\u201cMy wife is inside and we\u2019re waiting for the good news,\u201d said Ismail Hossein, a Bangladeshi American who was standing outside Federal Plaza immigration court with his young daughter. \u201cWe applied for that last June, now it\u2019s July so it\u2019s been more than a year.\u201d\r\n\r\nHossein\u2019s wait hasn\u2019t been that long, however, according to data compiled and analyzed by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University. TRAC found that, on average, people in New York state have been waiting 1,002 days for their cases to be called, which is above the national average of 938 days. This number has only continued to rise, with the average waiting time for an immigration case being 863 days, in 2020 and 696, in 2021.\r\n\r\n\u201cFor those people who have to wait for years, and years to have their cases decided, it essentially means they\u2019re living their lives in limbo,\u201d Austin Kocher, an assistant professor at TRAC, told Gothamist\/WNYC. \u201cIt delays really basic things like being able to buy a house, getting involved in your kids\u2019 school, and it really forces people to make all kinds of really challenging decisions.\u201d\r\n\r\nThis has been further exacerbated by the backlog of pending immigration cases, a longstanding issue that has also taken a backseat to the pandemic. In 2021 alone there are over 1.3 million pending cases across the country, with nearly 150 thousand in New York - making it the state with the third largest number of pending immigration cases, behind only Texas and California. While cases first started to mount in 2009, Kocher points to the Trump administration as a catalyst causing the system to become increasingly overwhelmed.\r\n\r\n\u201cIt was really only under the Trump administration that that number has skyrocketed so much more,\u201d Kocher said, noting the rise from 500-thousand cases to 1.3 million in the last few years. \u201cBut now it\u2019s continued to grow and there doesn\u2019t really seem to be a clear solution other than substantial immigration reform.\u201d\r\n\r\nUnder current law, immigration courts fall under the jurisdiction of the United States Department of Justice, with judges hired by the sitting attorney general. So when Biden-appointee Merrick Garland announced in May that the courts would reopen on July 6th, the backlog landed on the desks of an estimated 500 immigration judges nationwide.\r\n\r\n\u201cIndividuals that have waited to have their day in court, if their cases are reset, may have to go to the end of our dockets,\u201d Judge Amiena Khan, president of the National Association of Immigration Judges, told Gothamist\/WNYC. \u201cFor many judges in the New York courts, that could mean all the way out to December 2023.\u201d\r\n\r\nSome advocacy groups have pointed to a recent memorandum from the Office of the Principal Legal Advisor to the immigration courts, which followed an executive order from President Joe Biden and aims to address the backlog. And while advocates believe it will help in some situations, they say it is not a long-term solution.\r\n\r\n\u201cThere are still decisions in place which impede immigration judges\u2019 ability to manage their own dockets,\u201d Evangeline Chan, director of the Immigration Law Project<\/a> at Safe Horizon, an NYC-based victims services organization, told us. \u201cWe remain concerned about the balancing of due process and the courts\u2019 need for expediency.\u201d\r\n\r\nChan highlighted one case of a client that has been adjourned by the court six times over the last four years. Judge Khan agrees that this is an issue to be addressed, not just in New York City, but on the national level as well.\r\n\r\n\u201cThe judges recognize the tasks that are before us,\u201d Judge Khan
