To raise awareness about ASA and make sure that survivors of sexual abuse, like E. Jean Carroll, can seek justice against the person(s) who harmed them, we\u2019ll break down the following in this blog post:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>How the ASA works<\/li>\n\n\n\n<li>How long survivors of sexual abuse have to file a civil suit under ASA<\/li>\n\n\n\n<li>An opportunity to attend our press conference outside of the courthouse where E. Jean Carroll\u2019s trial is being held<\/li>\n\n\n\n<li>Next steps you can take to support victims and survivors<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-the-new-york-state-adult-survivors-act\">What is the New York State Adult Survivors Act?<\/h2>\n\n\n\n<p>ASA is a law that creates a pathway to justice for individuals who were sexually assaulted as adults but were prevented by the statute of limitations from suing their abusers. Its one-year lookback window provides sexual assault survivors a true legal path to justice.<\/p>\n\n\n\n<p>This act took a critical step to change the statute of limitations to allow survivors the opportunity to legally pursue a civil suit and hold the individuals(s)\/institution(s) who caused them harm accountable for their actions. The powerful voices of our Adult Survivors Act Survivors Coalition were instrumental in making this law a reality.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-long-do-survivors-have-to-file-a-civil-suit-under-asa\">How Long Do Survivors Have to File a Civil Suit Under ASA?<\/h2>\n\n\n\n<p>We want to be sure time-barred survivors know they have this limited opportunity to seek justice in our civil courts and file a civil suit under ASA. The ASA\u2019s lookback window opened on November 24, 2022, and will close this year on November 23, 2023.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-adult-survivors-act-press-conference\">Adult Survivors Act Press Conference<\/h2>\n\n\n\n<p>Safe Horizon held a press conference on Monday, May 8, 2023, in support of E. Survivors may want to hold the person who harmed them and\/or the institution that enabled that person accountable in the eyes of the law. Some survivors feel that it's a way to get others to understand that there is no one way that sexual assault happens.\r\n\r\n<b>Q: Could a Survivor be Sued for Suing?<\/b>\r\n\r\nIt is possible. They may file a counterclaim, most likely for defamation for \u201charming their reputation.\u201d\r\n\r\n<b>Q: Will the Survivor Owe Money if they Lose?<\/b>\r\n\r\nIt depends. If the court finds the case valid and there aren\u2019t valid counterclaims against the survivor, then chances are that they won't owe money.\r\n\r\n<a href=\"https:\/\/www.youtube.com\/watch?v=P7ZmJteJKoY&amp;t=2815s\" target=\"_blank\" rel=\"noopener\"><b>Q: Can Survivors Sue Anonymously<\/b><\/a>\r\n\r\nIt is possible but it isn't guaranteed. At the very onset of the case, lawyers can file motions to proceed anonymously. Most lawsuits are filed publicly, and the legal papers are accessible, but there can be exceptions in cases where the plaintiff is a sexual assault survivor. There's also just a journalistic code of conduct where journalists do not say the name of plaintiffs in sexual assault cases unless they have previously discussed the case themselves.\r\n\r\n<a href=\"https:\/\/www.youtube.com\/watch?v=P7ZmJteJKoY&amp;t=3002s\" target=\"_blank\" rel=\"noopener\"><b>Q: What if there is no Evidence of What Happened?<\/b><\/a>\r\n\r\nEvidence or what we call \u201ccorroborated evidence\u201d, or \u201ccorroboration\u201d is sometimes needed and sometimes not needed. Typically, abusers don't abuse their victims in the presence of anybody else so it can be hard to come by.\r\n\r\nExamples of this include witnesses the survivor spoke to, notes, diary or journal entries, text messages, emails, letters, and photographs.\r\n\r\n<b><a href=\"https:\/\/www.youtube.com\/watch?v=P7ZmJteJKoY&amp;t=3131s\" target=\"_blank\" rel=\"noopener\">Q: What if the Abuser who Caused Harm Passes or Passed Away?<\/a><\/b>\r\n\r\nAlthough you cannot sue a dead person, you can sue their estate if they have one.
