{"id":4481,"date":"2017-05-19T16:45:23","date_gmt":"2017-05-19T16:45:23","guid":{"rendered":"http:\/\/www.safehorizon.org\/?p=4481"},"modified":"2025-10-07T15:03:52","modified_gmt":"2025-10-07T19:03:52","slug":"advocates-child-abuse-victims-reform-statute-limitations","status":"publish","type":"post","link":"https:\/\/www.safehorizon.org\/child-victims-act","title":{"rendered":"Child Victims Act"},"content":{"rendered":"<p><em>By Michael Polenberg<\/em><br \/>\n<em>May 19, 2017<\/em><\/p>\n<p>New York State has some of the nation\u2019s most prohibitive\u00a0statute of limitation\u00a0laws when it comes to supporting adult survivors of childhood sexual abuse.\u00a0Most survivors only have until the age of 23 to bring court proceedings against those responsible for the abuse.<\/p>\n<p>For many years, Safe Horizon has joined with a coalition of survivors, victim service providers, advocacy organizations, and national experts to advocate for legislation that would expand the ability for survivors of childhood sexual abuse to seek relief in the courts. This legislation is known as the Child Victims Act. In 2018, Safe Horizon and the other coalition members have been meeting with key members of the Governor\u2019s administration and New York State Legislature to move this legislation forward.<\/p>\n<p>There are three specific points the coalition is advocating for to be part of the Child Victims Act:<\/p>\n<ul>\n<li>Extend the criminal and civil statute of limitations going forward to allow survivors a greater opportunity to seek justice in our courts.<\/li>\n<li>Create a one-year retrospective \u201cwindow\u201d to allow victims over the age of 23 to be able to initiate a civil lawsuit.<\/li>\n<li>Eliminate the 90-day notice of claim for litigation against public institutions, which has been as a barrier for victims of abuse and their families.<\/li>\n<\/ul>\n<p>The long-overdue legislation would reform New York\u2019s overly rigid statute of limitation laws for survivors of childhood sexual abuse, and allow more time to bring criminal charges and file civil litigation against those responsible.<\/p>\n<p>Unfortunately, Senate Republicans have failed to hold even a single hearing on the Child Victims Act in 2018. They have failed to broaden the path to justice for survivors of childhood sexual abuse. Senate Majority Leader John Flanagan and his conference continue to protect institutions from liability instead of aligning with survivors seeking justice.<\/p>\n<p>While there is still much work to be done to advance legislation with all three points the coalition is advocating for, I\u00a0remain confident meaningful reform will happen. And Safe Horizon remains absolutely committed to seeing this bill passed. Our support will not waver.<\/p>\n<p>New York State arbitrarily says once most survivors of sexual abuse turn 23 they lose the right to have their day in court. We vigorously oppose this arbitrary time limit. Abusers should not be able to run out the clock on being held accountable. The lookback window also allows survivors to file civil claims against any institution that protected their abuser.\r\n\r\nThe one year window opens August 14.\r\n\r\nThe Child Victims Act also creates a meaningful statute of limitation reform for survivors of childhood sexual abuse in New York State. Before this new law, New York State had one of the most restrictive statute of limitations in the country. Now, survivors will have greater opportunities to hold their offenders accountable in a court of law.\r\n\r\nDuring the summer of 2019, we will be providing information on this website for survivors of childhood sexual abuse in New York State. This will include basic facts about the new law, where to turn to for help and support, and other important information.
