{"id":5937,"date":"2018-06-08T19:10:25","date_gmt":"2018-06-08T19:10:25","guid":{"rendered":"http:\/\/www.safehorizon.org\/?p=5937"},"modified":"2025-06-10T14:42:54","modified_gmt":"2025-06-10T18:42:54","slug":"separating-immigrant-families-increases-human-trafficking-vulnerabilities","status":"publish","type":"post","link":"https:\/\/www.safehorizon.org\/statements-and-press-releases\/separating-immigrant-families-increases-human-trafficking-vulnerabilities\/","title":{"rendered":"Separating Immigrant Families Increases Vulnerabilities to Human Trafficking"},"content":{"rendered":"<p><em>June 8, 2018<\/em><\/p>\n<p>Safe Horizon established our Anti-Trafficking Program (ATP) in 2001 to provide coordinated case management and legal services for survivors of human trafficking in New York City. Today, ATP is the largest provider of anti-trafficking services on the East Coast, and one of the largest in the U.S. We work directly with clients, and we increase public awareness through advocacy, trainings, and technical assistance. As a thought leader in the victims services field, we have developed and currently provide trainings on recognizing and combating the effects of human trafficking, a service which we deliver locally, state-wide, and nationally, including to policymakers, as a member of the Alliance To End Slavery and Trafficking (ATEST).<\/p>\n<p>Below is a statement from ATEST, which Safe Horizon is a member of. They explain how separating immigrant families increases vulnerabilities to human trafficking:<\/p>\n<blockquote><p>The Trump administration has signaled a\u00a0<a href=\"https:\/\/www.reuters.com\/article\/us-usa-immigration-children\/u-s-cements-plans-to-separate-families-crossing-border-illegally-idUSKBN1I82AB\" target=\"_blank\" rel=\"noopener\">potential plan<\/a>\u00a0to use military bases for holding immigrant children who cross the southern border. These children would include both unaccompanied minors and children separated from their families by the U.S. government. The Alliance to End Slavery and Trafficking (ATEST) issued the following statement in opposition.<\/p>\n<p>The administration\u2019s proposed plan to use military bases for detaining unaccompanied minors and children forcibly separated from their families after crossing the southern border into the United States is deeply troubling and will have significant adverse consequences. This policy would disrupt and harm families that are separated during detention. It is also in stark contrast to existing Office of Refugee Resettlement policy of placing an unaccompanied child in the least restrictive setting that is in the best interests of the child.<\/p>\n<p>Foreign national minors crossing into the United States, whether unaccompanied or subsequently separated from their families, are already uniquely vulnerable to human trafficking. Many risk factors that contribute to the human trafficking of foreign-national youth \u2013 including language barriers, lack of a support system, economic vulnerability and a history of prior abuse, among others \u2013 already exist for many minors crossing into the United States. These factors would be exacerbated by this potential detention policy. Deliberate isolation of immigrant youth directly eliminates any safety net they may have had in the U.S., and renders them completely reliant on potential traffickers. Furthermore, this policy may encourage families to separate even before coming into contact with law enforcement, and to avoid such contact, which renders each individual more vulnerable to trafficking and less likely to access assistance if they are victims of trafficking.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/106th-congress\/house-bill\/3244\" target=\"_blank\" rel=\"noopener\">Victims of Trafficking and Violence Prevention Act (TVPA)<\/a>\u00a0defines human trafficking as a modern form of slavery and includes both sex and labor trafficking. Immigrant youth who meet the federal definition of trafficking encompass all genders and demographics and are at risk of forced labor, sexual exploitation or survival sex. They may not know their rights or understand that they are being exploited, and further restricting their movement by detention increases their vulnerability to traffickers seeking to exploit their lack of opportunities for legitimate work and fear of deportation. In many cases, individuals entering the U.S., including children, are fleeing human trafficking in their country of origin.<\/p>\n<p>It is critical that the administration ensure that all families crossing the southern border are not separated, but are instead kept together to strengthen their social safety networks and that unaccompanied minors are given immediate access to interpreters, culturally competent services, legal and immigration assistance, housing and medical care, and assistance with family reunification.<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>The Trump administration has signaled a potential plan to use military bases to hold immigrant children who cross the southern border. The Safe Horizon Anti-Trafficking Program (ATP) assists victims of this crime including men and women, adults and children, foreign nationals and U.S. citizens in cases of both labor trafficking and sex trafficking. While some victims of trafficking are hidden behind locked doors in private homes or brothels, others are in plain sight in restaurants, hotels or retail stores. Traffickers use a variety of tactics to control their victims including physical restraint and psychological coercion.\r\n\r\nSince 2000, the U.S. has taken a global, holistic approach to combating human trafficking by enacting and reauthorizing the Trafficking Victims Protection Act (TVPA), the first comprehensive federal law to address human trafficking. After its initial passing, every several years the law has to be reauthorized, the Trafficking Victims Protection Reauthorization Act (TVPRA), to maintain core measures and increase protections to ensure we continue the fight against an evolving crime. In this post, I will explain the important components of this law and how it enables our ATP to help human trafficking victims.\r\n<h1>Explanation of the Trafficking Victims Protection Act<\/h1>\r\nThe three arms of the Trafficking Victims Protection Act are prevention, protection and prosecution.\r\n<ul>\r\n \t<li>The preventative branch of the TVPA focuses on building awareness of trafficking and provides for international initiatives to deter and prevent vulnerability to trafficking as well as\u00a0establishing the Office to Monitor and Combat Trafficking in Persons in the State Department, responsible for publishing an annual report describing and ranking the efforts of countries to combat human trafficking<\/li>\r\n \t<li>The TVPA\u2019s protection initiative enables human trafficking victims to receive critical public benefits and creates immigration protections for foreign national victims of human trafficking who are involved in the investigation and prosecution of their traffickers<\/li>\r\n \t<li>The TVPA\u2019s prosecution arm creates several enumerated crimes for human trafficking and mandates that traffickers pay restitution to their victims<\/li>\r\n<\/ul>\r\nEvery few years, the Trafficking Victims Protection Act is reauthorized with amendments that reintegrate findings from past efforts. This process furthers protections that are vital to helping human trafficking victims.\r\n<h1>How the Trafficking Victims Protection Act Enables the Safe Horizon Anti-Trafficking Program to Help Human Trafficking Victims<\/h1>\r\nThe TVPA allows ATP to provide critical assistance to victims of trafficking so that they may heal from the trauma of their experience and build a stable life free of abuse and coercion. Because of the TVPA, our team of intensive case managers and attorneys can assist victims of trafficking with accessing public benefits and in applying for immigration relief crucial to their stability and healing process. The overall prevention efforts of the TVPA fuel our advocacy efforts to continue supporting trafficking victims on their road to healing.\r\n<h1>If TVPRA is Not Reauthorized: The Consequences<\/h1>\r\nTVPRA is a major reason why ATP is able to help human trafficking victims overcome their trafficking situations. Safe Horizon\u2019s Immigration Law Project (ILP) is staffed with trained and experienced attorneys that advocate on behalf of immigrant survivors of crime, torture, or abuse in New York City. The statements and conversations around immigration during the recent presidential election have sparked numerous concerns, which I will address in the following blog post.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\" id=\"h-what-changes-has-ilp-seen-since-the-2016-presidential-election\">What Changes Has ILP Seen Since the 2016 Presidential Election?<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>We have received many calls from clients and others in our community who have expressed increased concern and anxiety.&nbsp;It is very important that anyone with questions speaks with a qualified legal representative. Talking to an immigration law expert can help one to better understand their rights, evaluate their and their families\u2019 eligibility for permanent immigration relief, and create a safety plan to protect them and their children should any issues regarding their immigration status arise in the future.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>It is also important to remember that we do not yet know if any changes will take place after January 20<sup>th<\/sup>. Nevertheless, we are working hard to ensure that we are able to quickly respond to any changes that might occur, and will continue to promote and protect the rights of undocumented immigrants in our community.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\" id=\"h-should-undocumented-immigrant-victims-of-crime-still-feel-comfortable-seeking-help-if-they-need-it\">Should Undocumented Immigrant Victims of Crime Still Feel Comfortable Seeking Help If They Need It?<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>For victims of violence or abuse, nothing is more important than safety. Every individual has a right to live free from harm, abuse, and violence. Local, city, and state agencies in New York firmly support all peoples\u2019 rights to have access to services to ensure their safety. This includes access to; emergency shelter, emergency health care, courts to seek orders of protection, law enforcement and the criminal justice system.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Since 2003 New York has been a \u201cSanctuary City.\u201d This means that city agencies are not authorized to report people who seek assistance to immigration authorities. These agencies include New York Police Department (NYPD), Administration for Children\u2019s Services (ACS), Human Resources Administration (HRA), and Family Courts.&nbsp;In recent weeks, local and city agencies, our Mayor, and our Governor, have all reasserted their commitment to protecting undocumented immigrants in our communities.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>If you are afraid and need help call one of our three 24-hour hotlines that operate seven days a week, 365 days a year. DACA gives undocumented immigrants that meet certain criteria the ability to obtain employment authorization and protection from deportation. DACA has enabled undocumented immigrants to continue their education, obtain jobs, and advance their careers.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>We are hopeful that policy makers will recognize the positive contributions that DACA has made possible, &nbsp;and will advocate for its continuation. However, given the adversarial statements made during the election, we do not recommend that people submit new applications for DACA at this time.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>For people who currently have DACA and who want to renew their status, we recommend speaking with an attorney in advance about the risks and the practicalities of whether their applications would be evaluated prior to any change in law.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\" id=\"h-what-can-i-do-to-best-protect-myself-and-my-family\">What Can I do to Best Protect Myself and My Family?<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Immigration law is complex, and it is important to seek qualified legal advice if you have any questions. One of the best things someone can do is to create a safety plan in the event that they are apprehended and\/or arrested by U.S. Immigration and Customs Enforcement (ICE).<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>The Immigrant Legal Resource Center has created a fantastic guide to creating a family preparedness plan that includes arranging for childcare, keeping a list of important information for caregivers as well as access to legal documents or accounts they may need, and ensuring that your family or friends know who to contact and what to do if you are detained.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><a href=\"https:\/\/www.ilrc.org\/sites\/default\/files\/resources\/family_preparedness_plan.pdf\" target=\"_blank\" rel=\"noopener\">Read ILRC\u2019s Family Preparedness Guide Here.<\/a><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\" id=\"h-what-else-should-i-know\">What Else Should I Know?<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>You have rights! Immigrants, regardless of their status, have rights and protections afforded to them under the law, including the right to due process. So what does this mean?<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list -->\n<ul class=\"wp-block-list\"><!-- wp:list-item -->\n<li>Someone\u00a0with a previously approved application for permanent status is not at risk of losing their status\u00a0based on any possible future changes in law and policy;<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>Someone with a pending application for immigration relief will\u00a0be given an opportunity to have their eligibility for such relief to be evaluated and determined;<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>Someone who does not have permanent status or a pending application, must be given their due process rights, including the opportunity to present any claim for immigration relief before an immigration judge;<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>Someone who is afraid of being returned to their country of origin must, in most circumstances, be given an opportunity to be heard regarding that fear before being removed.<!-- wp:list -->\n<ul class=\"wp-block-list\"><!-- wp:list-item -->\n<li>If you are afraid to return to your country of origin for any reason, be sure to affirmatively state this to the immigration officer or official speaking with you.<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list --><\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>Someone with a prior deportation order is more at risk of immediate removal, so we recommend that if anyone has been previously removed from the United States and\/or has an arrest record (even without convictions) in the United States, they seek legal advice as soon as possible as they may be more at risk for future immigration action.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\" id=\"h-why-is-it-important-to-speak-with-an-immigration-lawyer\">Why Is It Important to Speak with an Immigration Lawyer?<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>There is a lot of fraud and misinformation being spread by non-legal advocates urging people to file applications for which they may not be eligible. This may put people more at risk, and it is important that they speak with a legitimate service provider before submitting any application to immigration.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>ILP remains dedicated and committed to promoting and protecting the rights of the vibrant and diverse immigrant communities that provide so much to our city and country. &nbsp;We will continue to stand with them, and with survivors of crime throughout New York City.
