When a survivor defends themselves, our criminal justice system responds with harsh punishment instead of compassion and assistance. This is largely a result of New York State\u2019s current sentencing structure, which does not allow judges enough discretion to consider the impact of domestic violence when determining sentences. For many survivors, this leads to long, unfair prison sentences.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-6857\" src=\"https:\/\/www.safehorizon.org\/wp-content\/uploads\/2019\/03\/Incarcerated-Women-Intimate-Partner-Violence-1024x1024.png\" alt=\"Incarcerated Women Intimate Partner Violence\" width=\"600\" height=\"600\" srcset=\"https:\/\/safehorizon.wpenginepowered.com\/wp-content\/uploads\/2019\/03\/Incarcerated-Women-Intimate-Partner-Violence-1024x1024.png 1024w, https:\/\/safehorizon.wpenginepowered.com\/wp-content\/uploads\/2019\/03\/Incarcerated-Women-Intimate-Partner-Violence-150x150.png 150w, https:\/\/safehorizon.wpenginepowered.com\/wp-content\/uploads\/2019\/03\/Incarcerated-Women-Intimate-Partner-Violence-300x300.png 300w, https:\/\/safehorizon.wpenginepowered.com\/wp-content\/uploads\/2019\/03\/Incarcerated-Women-Intimate-Partner-Violence-768x768.png 768w, https:\/\/safehorizon.wpenginepowered.com\/wp-content\/uploads\/2019\/03\/Incarcerated-Women-Intimate-Partner-Violence.png 1080w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/p>\n<p>Safe Horizon joined the Coalition for Women Prisoners in support of the Domestic Violence Survivors Justice Act to help domestic violence survivors get fair treatment in court. This includes a broad coalition of over 130 organizations, women\u2019s groups, thousands of individuals from across the state, and Governor Cuomo, who has included it in his 2019 Executive Budget.<\/p>\n<p>On March 12, 2019, the New York State Senate voted to pass the Domestic Violence Survivors Justice Act. Here is how it will help survivors:<\/p>\n<ul>\n<li><strong><u>The Domestic Violence Survivors Justice Act Empowers Judges<\/u><\/strong>\n<ul>\n<li>The Domestic Violence Survivors Justice Act allows judges to sentence survivors to shorter prison terms. This applies to offenses that directly relate to the violence. In some cases, judges will be able to sentence survivors to community-based alternative-to-incarceration programs.\n<ul>\n<li>The Domestic Violence Survivors Justice Act contains protections to ensure the appropriate use of this discretion. A judge can only grant an alternative sentence if they find that: (1) the defendant was, at the time of the offense, a victim of domestic violence subjected to substantial physical, sexual or psychological abuse inflicted by a spouse, intimate partner or relative; (2) the abuse was a \u201csignificant contributing factor\u201d to the defendant\u2019s participation in the crime; and, (3) a sentence under current law would be \u201cunduly harsh.\u201d<\/li>\n<\/ul>\n<\/li>\n<li><strong><u>The Domestic Violence Survivors Justice Act Gives Incarcerated Survivors Another Chance<\/u><\/strong>\n<ul>\n<li>The Domestic Violence Survivors Justice Act gives survivors who are currently in prison the opportunity to apply for resentencing.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>The Domestic Violence Survivors Justice Act will help New York address years of injustice suffered by survivors given harsh penalties for acting to protect themselves and their families and will decrease the number of survivors who are victimized by the very system that should protect them.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Domestic Violence Survivors Justice Act would begin to address the years of injustice faced by domestic violence survivors.<\/p>\n","protected":false},"author":13,"featured_media":{"id":6856,"alt_text":"New Law to Help Incarcerated Domestic Violence Survivors in New York State","caption":"","description":"","media_type":"image","media_details":{"width":2121,"height":1414,"file":"2019\/03\/New-Law-to-Help-Incarcerated-Domestic-Violence-Survivors-in-New-York-State.jpg","sizes":{"thumbnail":{"file":"New-Law-to-Help-Incarcerated-Domestic-Violence-Survivors-in-New-York-State-150x150.jpg","width":150,"height":150,"mime-type":"image\/jpeg","source_url":"https:\/\/www.safehorizon.org\/wp-content\/uploads\/2019\/03\/New-Law-to-Help-Incarcerated-Domestic-Violence-Survivors-in-New-York-State-150x150.jpg"},"medium":{"file":"New-Law-to-Help-Incarcerated-Domestic-Violence-Survivors-in-New-York-State-300x200.jpg","width":300,"height":200,"mime-type":"image\/jpeg","source_url":"https:\/\/www.safehorizon.org\/wp-content\/uploads\/2019\/03\/New-Law-to-Help-Incarcerated-Domestic-Violence-Survivors-in-New-York-State-300x200.jpg"},"medium_large":{"file":"New-Law-to-Help-Incarcerated-Domestic-Violence-Survivors-in-New-York-State-768x512.jpg","width":768,"height":512,"mime-type":"image\/jpeg","source_url":"https:\/\/www.safehorizon.org\/wp-content\/uploads\/2019\/03\/New-Law-to-Help-Incarcerated-Domestic-Violence-Survivors-in-New-York-State-768x512.jpg"},"large":{"file":"New-Law-to-Help-Incarcerated-Domestic-Violence-Survivors-in-New-York-State-1024x683.jpg","width":1024,"height":683,"mime-type":"image\/jpeg","source_url":"https:\/\/www.safehorizon.org\/wp-content\/uploads\/2019\/03\/New-Law-to-Help-Incarcerated-Domestic-Violence-Survivors-in-New-York-State-1024x683.jpg"}},"image_meta":{"aperture":"0","credit":"Getty Images\/iStockphoto","camera":"","caption":"woman prison missing hand at cage jail no freedom of female right","created_timestamp":"0","copyright":"Korn V.
