The lookback window also allows survivors to file civil claims against any institution that protected their abuser.<\/p>\n<p>The one year window opens August 14.<\/p>\n<p>The Child Victims Act also creates a meaningful statute of limitation reform for survivors of childhood sexual abuse in New York State. Before this new law, New York State had one of the most restrictive statute of limitations in the country. Now, survivors will have greater opportunities to hold their offenders accountable in a court of law.<\/p>\n<p>During the summer of 2019, we will be providing information on this website for survivors of childhood sexual abuse in New York State. This will include basic facts about the new law, where to turn to for help and support, and other important information. We have joined with a coalition of survivors, victim service providers, advocacy organizations, and national experts to advocate for legislation that would expand the ability for survivors of childhood sexual abuse to finally have their day in court. I am ecstatic to announce that these survivors can now seek the justice they deserve.\r\n<iframe style=\"border: none; overflow: hidden;\" src=\"https:\/\/www.facebook.com\/plugins\/post.php?href=https%3A%2F%2Fwww.facebook.com%2Fsafehorizon%2Fposts%2F10156226576343196%3A0&amp;width=500\" width=\"500\" height=\"398\" frameborder=\"0\" scrolling=\"no\"><\/iframe>\r\n<h1>Background of the Child Victims Act and the History of the CVA in Albany<\/h1>\r\nFor many years, Safe Horizon has helped lead a coalition of survivors, advocates, organizations, law enforcement, and legislators from around the state to better align our laws with the experiences of childhood sexual abuse survivors. Known as the Child Victims Act (CVA), this legislation was created to enact meaningful and long-overdue statute of limitation reform.\r\n\r\nIn New York State, statute of limitation laws required most survivors of childhood sexual abuse to either file criminal charges or seek civil damages by the relatively young age of 23.\r\n\r\nThanks to our coalition of advocates and partners, the Child Victims Act has finally passed!\r\n\r\nThe Child Victims Act includes these three main components:\r\n<ul>\r\n \t<li>A new statute of limitations that allows civil lawsuits in child abuse cases for survivors to file until their 55th birthday.<\/li>\r\n \t<li>A retrospective \u201cwindow\u201d of one year to allow victims over the age of 23 to be able to initiate a civil lawsuit.<\/li>\r\n \t<li>A new statute of limitations that allows criminal cases to be prosecuted until the survivor\u2019s 28<sup>th<\/sup> birthday<\/li>\r\n<\/ul>\r\nPlease join us and share this post to celebrate this hard-earned victory for survivors!","post_title":"The Child Victims Act Passed!
