New York State has defined what falls under the designation of hate crimes <a href=\"https:\/\/www.ny.gov\/designated-hate-crimes\">found here<\/a>. Unfortunately, hate crimes have an outsized impact compared to most other types of crimes, as other members of the targeted community feel the detrimental effect of the crime on their safety and quality of life. <\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\" id=\"h-programs-and-resources-for-victims-of-hate-crimes\">Programs and Resources for Victims of Hate Crimes<\/h2>\n\n\n\n<p>Safe Horizon\u2019s mission is to provide support, prevent violence and promote justice for victims of crime and abuse, including dedicated services for survivors of hate crime. Here\u2019s some information on what defines a hate crime, how to report incidents to the police, and ways to document your experience if you don\u2019t want to get the police involved.<\/p>\r\n\r\n<h3 id=\"kX89NJ\">How do I report a hate crime to the police in New York City?<\/h3>\r\n<p id=\"Lnkscp\">If you are the victim of a hate crime in New York City, or see or hear one, you can call 911 to report it to the police. If you do not speak English, say the name of the language that you speak in English, and you will be connected to a translator (you may have to hold).<\/p>\r\n<p id=\"C7poYY\">You will then be asked to state your location and describe what is happening. If the police arrive after the perpetrator has fled the scene, you will be asked to give as much detail as possible about what they looked like, what they said and what happened.<\/p>\r\n<p id=\"bsxat7\">Not every anti-Asian incident is a hate crime under New York law. Keep reading to learn more about what to do no matter what kind of bias incident you may have experienced or witnessed.<\/p>\r\n\r\n<h3 id=\"o0EQn8\">How do authorities define a hate crime in New York?<\/h3>\r\n<p id=\"y19SWK\">According to New York State law, a person commits a hate crime when they intentionally select a victim or commit an offense because of the person\u2019s race, skin color, national origin, ancestry, gender, religion, religious practice, age disability or sexual orientation.<\/p>\r\n<p id=\"RRkqnX\">But legally speaking, incidents of hate and bias are not categorized as crimes. For example, if someone says, \u201cGo back to China, you brought COVID-19\u201d to an Asian person, it would be considered a non-criminal bias incident. Similarly, if someone spat on an Asian person without saying anything, it would be considered harassment. Most of the time cases like these are never prosecuted.<\/p>\r\n<p id=\"YoxamG\">However, if authorities determine that a crime was committed,\u00a0<em>and<\/em>\u00a0that the crime was motivated by bias, the incident could be considered a hate crime, making a criminal sentence more severe. What resources are available to me?<\/h3>\r\n<p id=\"WXRebB\">If you are a victim of anti-Asian or other hate, you may be eligible for compensation, even if you did not experience physical violence.<\/p>\r\n\r\n<ol>\r\n \t<li id=\"X48IPZ\"><strong>Victim compensation<\/strong>: The New York State Office of Victim Services works with crime victims to connect them to compensation. Depending on the situation, OVS may be able to help you secure financial relief and medical benefits. More information can be found\u00a0<a href=\"https:\/\/ovs.ny.gov\/faq\">here<\/a>. Their intake form can be found\u00a0<a href=\"https:\/\/go.redirectingat.com\/?id=&amp;xs=1&amp;url=https%3A%2F%2Fwww.surveymonkey.com%2Fr%2FXH9CWNG&amp;referrer=thecity.nyc&amp;sref=https%3A%2F%2Fwww.thecity.nyc%2F2021%2F4%2F20%2F22392870%2Fanti-asian-hate-crimes-help-nyc\" target=\"_blank\" rel=\"sponsored nofollow noopener\">here<\/a>.<\/li>\r\n \t<li id=\"Nwpupv\"><strong>Mental health support:\u00a0<\/strong>NYC Well connects you to free, confidential mental health support in more than 200 languages. You can speak to a counselor 24 hours a day 7 days a week by calling: 1-888-692-9355, by texting WELL (9355) to 65173, or chat with them online\u00a0<a href=\"https:\/\/nycwell.cityofnewyork.us\/en\/get-help-now\/chat-with-a-counselor-now\/\">here<\/a>.<\/li>\r\n \t<li id=\"oNyoH0\"><strong>Free lock change:\u00a0<\/strong>Certain victims of hate crimes and bias incidents may be eligible to have their locks changed for free through\u00a0<a href=\"https:\/\/www.safehorizon.org\/project-safe-lock-replacement\/\">Safe Horizon\u2019s Project Safe<\/a>. In order to qualify you need to have filed a police report within the last 30 days. Call 866-689-HELP (4357) to see if you are eligible and schedule an appointment.<\/li>\r\n<\/ol>\r\n<h3 id=\"oTnxld\">Can I still report an incident of hate that I witnessed or experienced in the past?<\/h3>\r\n<p id=\"GtpAI5\">Yes. There are multiple ways to report incidents of hate to authorities, as well as to provide tips and other information. In some cases, police detectives may follow up with you after you report an incident. You will never be asked about your immigration status.<\/p>\r\n\r\n<ol>\r\n \t<li id=\"H12F3R\"><strong>Go to your local police precinct.<\/strong>\u00a0Find which one you live in and out how to contact them\u00a0<a href=\"https:\/\/www1.nyc.gov\/site\/nypd\/bureaus\/patrol\/find-your-precinct.page\">here<\/a>. You can submit your answers in one of the roughly 100 available languages.<\/li>\r\n \t<li id=\"nJmNtX\"><strong>Email:\u00a0<\/strong>The NYPD Asian American Hate Crimes Task Force at asianhctf@nypd.org.<\/li>\r\n<\/ol>\r\n<h3 id=\"jTb7bQ\">How can I report incidents of hate if I don\u2019t want to go to the police?<\/h3>\r\n<p id=\"QOz9gs\">Across the country, Asian American\/Pacific Islander community organizations have been collecting testimonies, tips, and stories to document the growing number of reported bias incidents against community members, and address the problems of underreporting. Here are some organizations that have created forms where you can report incidents of hate, and in some cases request help.<\/p>\r\n\r\n<ul>\r\n \t<li id=\"FC0Eqv\"><a href=\"https:\/\/www.aafederation.org\/aaf-anti-asian-bias-reporting-form\/\">Asian American Federation<\/a>\u00a0(For incidents in the New York tri-state area. How can I get involved?<\/h3>\r\n<p id=\"5ucIOB\">Community groups across the city have responded to<strong>\u00a0<\/strong>the wave of anti-Asian hate by creating mutual aid projects that seek to create safer neighborhoods for Asian New Yorkers and to provide an alternative to police intervention. Here are some of them:<\/p>\r\n\r\n<ul>\r\n \t<li id=\"CeMNL9\"><strong>Chaperoning:\u00a0<\/strong><a href=\"https:\/\/www.protectchinatown.com\/\">Protect Chinatown<\/a>\u00a0offers elderly Asians the opportunity to request a chaperone in Manhattan\u2019s Chinatown if they feel unsafe. Request a chaperone\u00a0<a href=\"https:\/\/docs.google.com\/forms\/d\/e\/1FAIpQLScfUAseK_Vz0zueo6Ojiibo4PqUxrHjaEoJ6TuRtTSK8mi9cQ\/viewform\">here<\/a>\u00a0or call (646) 543-4055.<\/li>\r\n \t<li id=\"LVAAGH\"><strong>Bystander intervention<\/strong>:\u00a0<a href=\"https:\/\/www.instagram.com\/mainstreetpatrol\/\">Main Street Patrol<\/a>\u00a0walks the streets of Flushing on Saturdays and Sundays with a group of volunteers who are trained in bystander intervention to de-escalate potentially violent situations. Request funds\u00a0<a href=\"https:\/\/stimulus.app\/#donate-cafemaddycab\">here<\/a>.<\/li>\r\n \t<li id=\"Ihz1J1\"><strong>Self-defense:<\/strong>\u00a0The Asian American Federation has put together a video series outlining self-defense techniques for Asian New Yorkers who feel unsafe. We provide support, prevent violence, and promote justice for all victims of crime and abuse, including <strong>victims of hate crimes<\/strong>. Every day, we help victims of hate crimes heal from trauma by providing caring and comprehensive services. These services include counseling, advocacy and safety planning and are available to anyone regardless of their immigration status.\r\n<h2>What Exactly is a Hate Crime?<\/h2>\r\nHate crimes target individuals, groups of individuals or property because of a perception or belief about race, ethnicity, gender, sexual orientation, religion or other characteristic defined under law. Hate crimes impact more than the specific target; they can also have a detrimental effect on the quality of life and safety in communities.\r\n<h2>How Often do Hate Crimes Occur? What are the latest available Hate Crime Statistics?<\/h2>\r\nLaw enforcement agencies have noticed an increase in hate crime incidents. The New York State Division of Criminal Justice Services reported that there was <a href=\"http:\/\/www.criminaljustice.ny.gov\/crimnet\/ojsa\/hate-crime-in-nys-2015-annual-report.pdf\">an increase in hate crimes against individuals by 7% from 2014 to 2015<\/a>. In addition, the <a href=\"https:\/\/ucr.fbi.gov\/hate-crime\/2015\/tables-and-data-declarations\/1tabledatadecpdf\">FBI Hate Crime Statistics reports a national increase of 20% from 2014 to 2015<\/a>. This upward trend implies that either more hate crimes are being committed or that more victims of hate crimes are coming forward to report.\r\n<h2>What You Can Do if You are a Victim of a Hate Crime<\/h2>\r\nIt is ultimately up to victims of hate crimes to decide if they want to involve law enforcement officials. They can also seek support from others such as professional counselors, clergy, trusted friends and\/or family.\r\n<h2>How Can Safe Horizon Provide Services for Victims of Hate Crimes?<\/h2>\r\nFor those not sure about what next steps to take, we have <a href=\"https:\/\/www.safehorizon.org\/community-programs\/\">Community Program offices<\/a> that serve all five boroughs. The Community Programs provide services including safety planning, advocacy, case management, information and referrals, supportive counseling and support groups.\r\n\r\nOur <a href=\"https:\/\/www.safehorizon.org\/our-services\/information-and-options\/crime-victim-assistance-program\/\">Crime Victim Assistance Program (CVAP)<\/a> works in tandem with law enforcement officials to help victims of all crime. CVAP advocates are currently in all precincts throughout New York City. They review police reports and reach out proactively to victims of crime and abuse to address their specific needs. CVAP advocates also meet with victims of<strong>\u00a0<\/strong>crime who may not have filed a police report but come into an NYPD precinct seeking assistance. The advocates speak 15 languages and can access Language Line as needed. They will work with any victim of crime, even if they do not have legal status in the U.S.\r\n\r\nSafe Horizon\u2019s <a href=\"https:\/\/www.safehorizon.org\/our-services\/legal-and-court-help\/family-court-programs\/\">Family Court Programs<\/a> and <a href=\"https:\/\/www.safehorizon.org\/our-services\/legal-and-court-help\/criminal-court-programs\/\">Criminal Court Programs<\/a> can also provide assistance in obtaining legal guidance.
