Even the settlement process can be frustrating as there is a lot of back and forth.<\/p>\n<p>In essence, survivors should be aware of the realities and have a support system they can rely on.<\/p>\n<p><a href=\"https:\/\/www.youtube.com\/watch?v=P7ZmJteJKoY&amp;t=1225s\" target=\"_blank\" rel=\"noopener\"><b>Q: I\u2019m a Survivor and I Want to File a Lawsuit Under the Adult Survivors Act \u2013 What Should I do Next?<\/b><\/a><\/p>\n<p>Since every sexual offense may not qualify under the Adult Survivors Act, you should speak with a lawyer who can help determine whether or not you have a case. <a href=\"https:\/\/ypdcrime.com\/penal.law\/article130.php\" target=\"_blank\" rel=\"noopener\">It may also be helpful to look through Article 130 which lists all the crimes under the Adult Survivors Act<\/a>.<\/p>\n<p>When you speak to a lawyer, you will have to give details about what you actually experienced \u2013 the abuse incidents themselves &#8211; which can be difficult to talk about with a stranger.<\/p>\n<p><a href=\"https:\/\/www.youtube.com\/watch?v=P7ZmJteJKoY&amp;t=1457s\" target=\"_blank\" rel=\"noopener\"><b>Q: How do I Decide on a Lawyer? What Kind of Lawyer Should I Use?<\/b><\/a><\/p>\n<p>Look for a lawyer who has experience working on cases involving sexual abuse and assault. A lawyer who has handled cases that are similar to yours can help navigate any issues that may arise in your case. Find a lawyer who you feel that you can trust.\u00a0<a href=\"https:\/\/www.safehorizon.org\/programs\/pick-lawyer-attorney-sexual-assault-case\/\" target=\"_blank\" rel=\"noopener\">For more guidance on how to pick a lawyer, our experts created this guide.<\/a><\/p>\n<p><b>Q: How do I find a lawyer?<\/b><\/p>\n<p>Safe Horizon cannot recommend specific lawyers or firms but can refer you to look at the <a href=\"https:\/\/victimbar.org\/finding-an-attorney\/\" target=\"_blank\" rel=\"noopener\">Crime Victim Bar Association page.<\/a><\/p>\n<p><b>If you are not sure if you want to file a lawsuit under the Adult Survivors Act and are looking for more general information, here are some questions to ask.<a name=\"beforefiling\"><\/a><\/b><\/p>\n<p><a href=\"https:\/\/www.youtube.com\/watch?v=P7ZmJteJKoY&amp;t=1030s\" target=\"_blank\" rel=\"noopener\"><b>Q: Why Should a Survivor Sue?<\/b><\/a><\/p>\n<p>Pursuing legal action is a very personal decision. Survivors may want to hold the person who harmed them and\/or the institution that enabled that person accountable in the eyes of the law. Some survivors feel that it&#8217;s a way to get others to understand that there is no one way that sexual assault happens.<\/p>\n<p><b>Q: Could a Survivor be Sued for Suing?<\/b><\/p>\n<p>It is possible. They may file a counterclaim, most likely for defamation for \u201charming their reputation.\u201d<\/p>\n<p><b>Q: Will the Survivor Owe Money if they Lose?<\/b><\/p>\n<p>It depends. If the court finds the case valid and there aren\u2019t valid counterclaims against the survivor, then chances are that they won&#8217;t owe money.<\/p>\n<p><a href=\"https:\/\/www.youtube.com\/watch?v=P7ZmJteJKoY&amp;t=2815s\" target=\"_blank\" rel=\"noopener\"><b>Q: Can Survivors Sue Anonymously<\/b><\/a><\/p>\n<p>It is possible but it isn&#8217;t guaranteed. At the very onset of the case, lawyers can file motions to proceed anonymously. Most lawsuits are filed publicly, and the legal papers are accessible, but there can be exceptions in cases where the plaintiff is a sexual assault survivor. There&#8217;s also just a journalistic code of conduct where journalists do not say the name of plaintiffs in sexual assault cases unless they have previously discussed the case themselves.<\/p>\n<p><a href=\"https:\/\/www.youtube.com\/watch?v=P7ZmJteJKoY&amp;t=3002s\" target=\"_blank\" rel=\"noopener\"><b>Q: What if there is no Evidence of What Happened?<\/b><\/a><\/p>\n<p>Evidence or what we call \u201ccorroborated evidence\u201d, or \u201ccorroboration\u201d is sometimes needed and sometimes not needed. Typically, abusers don&#8217;t abuse their victims in the presence of anybody else so it can be hard to come by.<\/p>\n<p>Examples of this include witnesses the survivor spoke to, notes, diary or journal entries, text messages, emails, letters, and photographs.<\/p>\n<p><b><a href=\"https:\/\/www.youtube.com\/watch?v=P7ZmJteJKoY&amp;t=3131s\" target=\"_blank\" rel=\"noopener\">Q: What if the Abuser who Caused Harm Passes or Passed Away?<\/a><\/b><\/p>\n<p>Although you cannot sue a dead person, you can sue their estate if they have one. The ASA made it possible for survivors of sexual violence to seek justice by filing a civil lawsuit against the person who caused them harm, even if the harm occurred many years ago. If the website has a laundry list of case types, such as motorcycle accidents, car accidents, medical malpractice, etc., the firm might not have expertise in sexual abuse cases.\u00a0<\/span>\r\n<h2 style=\"font-size: 28px; color: #00a5e3;\">How They Help Their Clients Manage the Emotional Challenges that Come with Filing Cases<\/h2>\r\n<span style=\"font-weight: 400;\">You\u2019ll want to feel like your lawyer has both legal expertise and the ability to provide support during triggering or emotionally challenging moments. For example, your lawyer should have a plan for providing emotional support when preparing you for a deposition or trial. <\/span>\r\n<h2 style=\"font-size: 28px; color: #00a5e3;\">How Much Expertise the Attorney or Lawyer Has Handling Sexual Abuse Cases<\/h2>\r\n<span style=\"font-weight: 400;\">To identify expertise you can look for their personal experience with sex abuse trials, opinion or legal articles they wrote, or speeches they give to professional organizations about best practices.<\/span>\r\n<h2 style=\"font-size: 28px; color: #00a5e3;\">How Long Have They Been Representing Victims of Sexual Abuse<\/h2>\r\n<span style=\"font-weight: 400;\">The more specific experience a lawyer has with sex abuse cases, the better. That way they can be better prepared to make good decisions and give good advice.\u00a0<\/span>\r\n<h2 style=\"font-size: 28px; color: #00a5e3;\">If the Law Firm or Lawyer's Primary Office is in New York State<\/h2>\r\n<span style=\"font-weight: 400;\">Although you can consider lawyers located out of state, those in New York will likely have a better understanding of The Child Victims Act or Adult Survivors Act. They also may have a deeper understanding of New York State laws.<\/span>\r\n<h2 style=\"font-size: 28px; color: #00a5e3;\">Does it Matter How Much Money a Lawyer Has Previously Made Their Clients?<\/h2>\r\n<span style=\"font-weight: 400;\">Not necessarily. In many cases, firms that tout large settlements didn\u2019t get that settlement through sexual abuse cases.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">But more importantly, you should consider a lawyer who cares more about you than about a settlement.\u00a0<\/span>\r\n<h2 style=\"font-size: 28px; color: #00a5e3;\">How Expensive Will Filing a Case be?<\/h2>\r\n<span style=\"font-weight: 400;\">While this depends mostly on your case, a lawyer should be able to give you a ballpark. They should also be clear about their fees, including any fees for an initial consultation, their hourly rate, and\/or how they collect their money.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">The lawyer should also be upfront about whether they take on cases against abusers with fewer assets.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">In cases against institutions, lawyers may accept payment after the trial ends.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">These are all discussions you should have before choosing a lawyer.\u00a0<\/span>\r\n<h2 style=\"font-size: 28px; color: #00a5e3;\">What if an Attorney or Lawyer Doesn\u2019t Take my Case?<\/h2>\r\n<span style=\"font-weight: 400;\">First, whether a lawyer decides to take a case is not a reflection on your value as a person or the trauma of your abuse. Every victim and survivor deserves access to safety and support.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">If a lawyer decides not to take your case, you can explore more options through the <\/span><a href=\"https:\/\/www.nycbar.org\/get-legal-help\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">NY City Bar Association <\/span><\/a><span style=\"font-weight: 400;\">or the <\/span><a href=\"https:\/\/victimbar.org\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">National Crime Victim Bar Association<\/span><\/a><span style=\"font-weight: 400;\">.
